Businessman charged for failing to pay Sh 50 million credit

A businessman had been charged with obtaining and failing to pay credit amounting to millions of shillings and issuing a bad cheque.

Sundip Jagdishroy Patel was charged with in incurring a debt or liability to Vijay Morjaria, obtained credit amounting to Sh 52, 385, 500 by falsely pretending that he was in a position to pay with interest inclusive.
Patel is alleged to have committed the offence on diverse dates between 12th December 2013 and 12th April 2014 at ICONEX Limited along Kijabe street in Nairobi.
The businessman was also charged with issuing a bad cheque in favour of the complainant Vijay Morjaria.
Patel was charged that on 31st December 2017 at Lusaka Road in Industrial area within Nairobi, he issued the complainant with a Sh 52 million cheque on his African Banking Corporation Bank account knowing it had insufficient funds.
The accused denied the charges before Chief Magistrate Francis Andayi and was released on a bond of Sh 2million and one surety of the same amount or a cash bail of Sh 500,000.
The prosecution confirmed to the court that the accused person has been unwell and that is why he unable to appear before court on Monday 5th March to answer to the charges.
The court had that the accused was accompanied to court this morning from the hospital by the investigating officer.
The case will be mentioned on 18th March and will be heard on 4th April 2018.
