Car dealer to serve 4.5 year jail term for defrauding clients Sh 7.5 million

A car dealer has been convicted to four and a half years in prison after being found guilty of defrauding his two clients of Sh 7.5 million for importation of luxury cars.

Kenneth Njiru Ngagi who was charged alongside his company Kensville Motors Limited five years ago is said to have failed to deliver two BMWs and a Lexux SUV from the United Kingdom as agreed.

While delivering her judgement, Chief Magistrate Martha Mutuku said that the prosecution proved its case beyond reasonable doubt.

Magistrate ruled that Njagi was not given an option to pay a fine because betrayed his customers’ trust and went ahead to ask traders to honour the agreements they enter with clients to avoid such incidents. 

“The complainants made several attempts to recover their money but this was in vain,” ruled the magistrate.

Lineal Company Limited and Kimani Maina were seeking to import the cars from the United Kingdom where Lineal deposited Sh 4.4 million to the car dealer for the importation of two BMWs and Maina deposited Sh 3.1 million for a Lexus SUV and waited for five years to receive the cars but in vain.

The convict will also do time for his company. He has given 14 days to appeal against the judgment.
