Court orders Sh 72M robbery suspects to be charged

Court has ordered six suspects detained in connection with the Sh 72 million theft to be charged tomorrow.

Chief Magistrate Martha Mutuku declined to grant police 10 days to to hold the suspects in order to complete investigations.

The Magistrate ruled that the fact that the suspects were arrested is an indication that the police has prima facie evidence against them.

The police had requested to hold APC Chris Machogi, CPL Duncan Kaveshi Luvuga, APC Boniface Mutua, Vincent Owuor, Alex Mutuku and Francis Muriuki to be detained at Langata Police station.

Further, the court ruled that a persons right to liberty should be respected at all times.

The court heard that the accused persons were not medical treatment as ordered by court yesterday.

The investigating officer told the court that Kenyatta National Hospital does not treat persons under police custody. It is alleged that they only treat those under prison authority.

The thing is, the investigator was in court when the order to have the suspects treated at KNH was made but he did not inform the court that they do not treat such cases.

Could this be an reflecting the suspect’s lawyers Cliff Ombeta’s submission that the police will delay to take them to hospital so that the wounds would he to hide evidence of torture?

The Magistrate ordered that they be treated at Mbagathi hospital and the report submitted in court tomorrow.

The case will be mentioned to confirm if the police will have pressed charges against the six.
