Engineer Kariuki Muchemi fails to appear in court for the second time

Engineer Kariuki Muchemi has failed to appear in court for the second time to plead to fraud charges.

The court heard that an unknown person appeared in court on 8th February 2022 to plead to the charges on behalf of Muchemi but was dismissed by the Presiding magistrate.

The investigating officer requested for more time to produce him court.

Chief Magistrate Wendy Kagendo directed the matter to be mentioned on 8th March 2022.

In January 2022, Muchemi did not appear in court to plead to the charges alongside his co-accused persons.

The engineer is accused of making a false Structural Integrity Investigation report on proposed construction of an office block for Multichoice Kenya on plot number L.R 3734/421 dated February 2017.

The accused is alleged to have committed the offense in February 2017 at an unknown place within the republic of Kenya, with intent to deceive.

Muchemi is also expected to plead to the charges of uttering false documents of the said structural Integrity investigation report.

Wilson Munyu Karaba, Stanley Kibathi, an architect and city lawyer Lavender Lucky Waindi pleaded not guilty to the charges.

Muchemi, Karaba, Kibathi, Waindi, Interconsults Engineers ltd, Connapex Consulting Engineers ltd and S.K Archplans are charged with conspiracy to defraud Multichoice K. Limited.

According to the charge sheet, on diverse dates between 1st February and 13th April 2017 at unknown place, being the directors of Interconsults Engineers ltd, Connapex Consulting Engineers ltd, S.K Archplans and Head of legal at MIH East Africa respectively jointly conspired together to defraud Cementers Kenya Ltd intentionally altered the structural Integrity Investigation report on proposed construction of Office block for Multichoice Kenya Ltd dated February, 2017.

The said report was altered to favor structural Engineers, Connapex Consulting Engineering ltd against Cementers Kenya ltd and to demand damages of Sh895 million from Cementers Kenya ltd.

Waindi is facing a solo charge of inciting another person to commit an offence. She is accused of inciting Muchemi to extract part of the said report that was to be presented to Cementers Ltd.

The accused persons are out on a cash bail of Sh100,000.
