Sarah Wairimu charged with murder of Dutch tycoon husband

The wife of the late tycoon Tob Cohen has been charged with his murder before a Nairobi court.

Sarah Wairimu Kamotho is alleged to have committed the offence between the night of 19th and 20th July this year.

Wairimu denied the charge before Justice Stella Mutuku.

Lawyer Murgor still on record

Prior to pleading to the charge, the court allowed her Philip Murgor to continue being on record for her.

The judge ruled that Murgor was properly before court and there is no conflict of interest if he represents her.

She further ruled that the publication of the gazette notice is meant to inform the public and has no bearing on the resignation of Murgor.

The prosecution and lawyer for the family of the deceased Cliff Ombeta wanted Murgor out of the matter on grounds that he was not properly before court since he was an employee of the ODPP as published in the January 2019 Kenya gazette.

However, Murgor responded to the allegations saying that he resigned from the office of the DPP after two months only that he had not been degazetted.

The state through prosecutor Catherine Mwaniki want the accused person denied bail and was seeking to be granted five days to prepare an affidavit replying on the bail application by her lawyer Philip Murgor.

The court heard that the prosecution needs time to contact the witness protection Agency and retract the statements of all the protected witnesses since they are going use some of them to show the court the compelling reasons as to why Wairimu should not be granted bail.

Wairimu’s lawyer Philip Murgor opposed the the request for more time stating that the accused has been in custody for 37 days therefore the prosecution had enough time to contact the witness protection program.

Justice Mutuku declined to grant the prosecution the five days and the parties to appear tomorrow for the bail application hearing.

The Dutch national was found dead in an underground tank at his palatial home almost two months after he went missing.

The police arrested his wife as the primary suspect in his murder.
