He further said this is a war between the President, Deputy President and himself.
“It is known that I have been opposing the government because the it was not legitimately elected by the people of Kenya,” he said.
Babu added that he respects the decision of the court even if he did not agree with it. He however stated that he will appeal the decision.
In addition, he said he was confident that he still win the re-election and will beat his opponents early in the morning.
“What I know is what doesn’t kill you will make you stronger. I am not a person who can be brought down easily,” Babu said.
The petition was filed by his close Jubilee opponent Francis Mureithi seeking nullification of Babu’s win and compulsion of IEBC to conduct fresh elections in accordance with the law.
He wanted the court to nullify Embakasi East election claiming that the exercise was marred with violence, intimidation, voter bribery among other electoral malpractices.
After the scrutiny and recount of votes for all the polling Babu still emerged the one with the most votes after garnering 46,817 votes against Mureithi who got 42,501.
At the same time, High Court uphold the election of Embakasi South MP Julius Mawathe after an unsuccessful petition by his opponent Irshad Sumra.
Justice Grace Nzioka said the petitioner failed to prove his case the required standard.
Sumra was also not satisfied with the the judgment and added he will appeal it.
Petition against Kitui Governor Charity Ngilu by her competitor Julius Malombe was also dismissed.
