Babu Owino still emerged winner after vote recount, DR report

A recount of votes for Embakasi East parliamentary seat indicates that MP Babu Owino won the August 8th general elections.

The report tabled in court by the Deputy Registrars (DR) Esther Mburu and Mbayaki Wafula showed that Babu got 46,817 votes against Jubilee’s Francis Mureithi who got 42,501.

According to the report, the scrutiny and recount of votes was a success, except for an incident where one of the deputy registrar’s phones was stolen.

The DR’s are positive the data collected and the report presented before the trial court will be helpful in the determination of the election petition.

Justice Joseph Sergon directed the parties to file or make their oral submissions on Wednesday 28 and will deliver the judgment on Friday 30th February.

After the August 8, 2017 general election, Babu was declared the winner with 46,587 votes against Mureithi’s with 42,253.

This indicated a difference of around 300 votes for the MP and around 250 votes for the petitioner.

Mureithi wants the court to nullify the election of Babu Owino and order for a fresh election.

He argues that the elections were not free, fair, accurate and verifiable as required by the constitution and the election laws.

Mureithi says in the petition that there was violence, voter intimidation, bribery and agents denied entry into stations.
