The High Court has allowed the case of the missing Dela Ward MCA Yussuf Hussein to be heard in-camera.
This is after the Inspector General of police made an application for in-camera proceedings on grounds that the issues raised will touch on matters of national security.
According to the application, IG Douglas Kanja wanted all members of the public, media and family members be locked out of the case.
However, Hussein’s lawyer Danstan Omari requested Justice Alexander Muteti to allow two family members to be present since it is their kin that is missing.
“My Lord, on the issue of family, it is their person who is missing. Police don’t identity bodies, it is family members who do so. They should let at least two people to be present, Omari submitted.
The court heard that the IG will be expounding in the affidavit by the family.
In the case, Hussein’s family moved to court seeking orders to have the Inspector General of Police and the DCI produce him in court.
In the application, Hussein’s cousin, Abdikadir Adibdullahi Ahmed wanted the court to summon the IG and DCI in whose custody they believed their kin to be.
The court heard that the MCA was kidnapped from a taxi while on his was to Pangani from South C on 13th September 2024 at around 9 PM.
The taxi driver said in his affidavit that the alleged kidnappers were driving in two Land Cruiser Prados and accosted the MCA along Lusaka Road forcing him out of the taxi at gun point.
