A Congolese national arrested in Kenya after being implicated in a 500 kilograms gold scam case has been charged with giving false information to a public servant.

Muderwa Mega Abedi alias Banambaya Kapapa Emery is accused of giving false information to immigration officer Hilary Kipng’eno Tonui by claiming that he was Banambaya Kapapa Emery of Congolese temporary travel document No. 132.30. A710093/2025 while his name is Muderwa Mega Abedi, in order to be cleared to exit Kenya.

Abedi, 66, who claims to be a musician is alleged to have committed the offense on 15th April 2025, at Namanga border within Kajiado County, in the Republic of Kenya.

He denied the allegations before Principal Magistrate Geoffrey Onsarigo.

The prosecution opposed his release on bail on grounds that he is a flight risk.

Through lawyers Danstan Omari and Shadrack Wambui, Abedi responded that he was not a flight risk and was ready to cooperate with investigators.

In his ruling, the magistrate found that no compelling reasons had been adduced to deny the accused person bail.

Abedi was therefore granted a bond of Sh 2 million plus one Kenyan surety with alternative cash bail of Sh 100,000.

The accused had initially been arraigned in court under a miscellaneous application where the police sought orders to detain him for seven days to conclude investigations in allegations of fraud.

The court heard the suspect had been cooperating with investigating officers until 15th April 2025 when he failed to avail himself.

The officers later learned that Abedi had been arrested at the Namanga boarder point with the said temporary Congolese travel document.

Investigating officer Corporal Paul Maina told the court that intelligence gathered indicated that the accused person was being assisted to escape by his accomplices.

The case will be mentioned on 12th May for pre-trial.
