Court adjourns Sh 300M land fraud case against a commissioner of land

A Nairobi court has deferred a case in which Commissioner of Lands and another are expected to plead to charges in Sh 300 million land fraud charges.

Commissioner of Lands Sammy Silas Komen Mwita and Brian Kiptoo Kiplagat are accused of forgery, abuse of office, giving false information among others.

The duo failed to plead to the charges on 1st June 2025 after the court was informed that they had moved to the High Court and obtained orders stopping their prosecution.

According to the charge sheet, the two are accused of conspiring to make a grant title without authority for Land Reference No. 209/9968 IR. No. 85847 with intent to defraud Rose Njoki King’au a parcel of land known as plot No. “A” Nairobi West, along Mai Mahiu Road, off Langata Road measuring approximately 0.12 hectares each and valued at Sh 150 million each.

Mwaita is also accused of making a Certificate of Title for the two plots without lawful authority or excuse, in the name of Shaba Trustees Limited, purporting it to be a genuine document issued by the Ministry of Lands.

In another count, the Commissioner is accused of abuse of office.

According to the charge sheet, Mwaita, being a person employed in the public service as a commissioner of lands caused to be made, fraudulent registration of the the grant title for plot “A” and “B” without consent of King’au, the rightful owner, in abuse of the authority of his office.

Mwaita and Kiplagat are accused of giving police false information.

The case will be mentioned on 11th July 2025.
