Court bars arrest of Embakasi MPs Gakuya and Mejja Donk over Gen Z protests funding

The High Court in Nairobi has issued orders prohibiting the arrest and detention of Embakasi North and Embakasi Central Members of Parliament James Gakuya and Benjamin Gathiru Mejja Donk on allegations of funding the Genz protests in the country.

Justice Chacha Mwita ruled that the orders against the DPP and the DCI shall be in force until 17th September 2024 when the matter will come up for mention.

“In the meantime, a conservatory order is hereby issued restraining the respondent, their agents and or servants from arresting, detaining, confining, pursuing and or in any other way interfering with the petitioners’ liberty in connection with the allegations giving rise to this petition until 17th September 2024,” ruled the judge.

Through lawyers Danstan Omari and Shadrack Wambui, the two politicians claim to have been taken from Parliament building on 31st July 2024 by DCI officers and taken to DCI Headquarters.

The lawmakers who are allies of Deputy President Rigathi Gachagua were allegedly interrogated and surrendered their phones to the DCI for forensic analysis.

While addressing media outside Milimani Law Courts, the lawyers said that other allies including staff of the Deputy President Rigathi Gachagua have also been questioned over the matter.
