Court issues summons against Utrotide Investments Limited Director in Sh 67M tax fraud case

A Nairobi court has issued summons to the director, Utrotide Investments Limited to appear in court and plead to charges involving Sh 67M tax fraud.

Principal Magistrate Caroline Mugo directed that Peterson Maina Maruhiu to appear in court on 21st April, 2026 for plea taking.

According to the charged present in court, Maruhiu, alongside Utrotide Investments are accused of knowingly and unlawfully making an incorrect statement in the Value Added Tax returns for the period 2023 by claiming fictitious purchases amounting to Sh 149,962,562, purporting them to be sales by Balsam Hardware Limited, thereby reducing their VAT liability for the period 2023 by Sh 23,994,010.

The accused persons are also charged with knowingly and unlawfully making an incorrect statement their VAT returns for the period 2023 by claiming fictitious purchases amounting to Sh 99,824,805 purporting them to be sales by Nyamerambo The Ark Company Limited, thereby reducing Tax liability for the said period by Sh 15,971,969.

In addition, Maruhiu and his company are accused of knowingly and unlawfully making an incorrect statement in their VAT returns for the period 2023 by claiming fictitious purchases amounting to Sh 90,819,437 purporting them to be sales by Super Ideal Hardware Limited, thereby reducing their VAT liability for the said period by Sh 14,531,110.

Lastly, the accused persons are charged with knowingly and unlawfully making an incorrect statement in thei VAT returns for the period 2023 by claiming fictitious purchases amounting to Sh 87,939,161 purporting them to be sales by Tena Arts and Brands Limited, thereby reducing their VAT liability for the said period by Sh 14,070,266.

The said offenses were allegedly committed between 20th February 2023 and 20th January 2024 within the Republic of Kenya.
