Court lifts warrant of arrest against Senator Allan Chesang

A Nairobi court has lifted a warrant of arrest against Trans Nzoia Senator Allan Chesang after failing to appear in court.

Senior Principal Magistrate Dolphina Alego lifted the warrant after Chesang told the court that his failure to attend court was because he had to attend the burial of one of his employees.

While asking the court lift the warrant, Chesang, through his lawyer apologized to the court and produced the burial permit.

“It was not the intention of the accused person to miss court. It was beyond his control and as such we pray for the leniency of the court and for the warrant to be lifted,” the defense submitted.

The lawmaker is charged alongside six other in Sh 25 million Department of Defense fake tender.

Other accused persons are Clifford Okoth Ongugo alias Victor Wandera, David Kahi Ambuku, Cliff Moseti Obwogi, Boniface Kamau Macharia, Ellyshah Onyango Oswago, and Esther Kalungu Ngotho.

The seven are accused of conspiring to steal Sh 25,950,000 from Wil Developers and Construction Limited purporting it to be a payment for 175,000 Jute Gunny Bags allegedly delivered to the Department of Defence in service of a Contract Refence No. MODP/SUPPLS/0451-270/2017-18/SP.

It is alleged that the accused persons committed the offense

between 28th December 2017 and 22nd March 2018 in Nairobi.

Chesang and his co-accused persons are also charged with obtaining a total of Sh 25 million from Johnson Wambua Mwanzia by pretending that they had acquired a trnder to supply to supply Jute Gunny Bags to the Department of Defence.

They accused persons are also facing several charges of forgery and uttering forged documents.

The Senator had made an application to have the charges against him withdrawn on grounds that he was willing to repay the Sh 17 million deposited into his bank account which saw him implicated in the scam.

However, the withdrawal of the case is yet to happen since the complainant claims he has not received any money from Chesang.

The magistrate directed the case to be mentioned on 7th May 2025 for the complainant to appear in court to confirm whether he had been paid.
