Four officials associated with the Nairobi Hospital including Dr Chris Bichange Munga Nyamaratandi have been released on a personal bond of Sh 5 million after being arraigned at the Milimani Law Courts.
Prior to being arraigned in court, the suspects had been held by the police in a vehicle at the Magistrate’s parking lot for hours.
Their lawyers, led by Nelson Havi and Cliff Ombeta demanded that the police produced them in court.
Other suspects are the Kenya Hospital Association Limited directors Samson Mbuthia Kinyanjui, Job Lukuru Obwaga and Valarie Akinyi Gaya.
The four are accused of failing to lodge with the registrar, the company’s financial statement for the year 2024.
Bichange and Kinyanjui are also accused of conflict of interest by receiving millions from Meritorious Insurance Agency, a company contracted by Kenya Hospital Association Limited.
According to the charge sheet, Bichange received Sh 4.8 million while Mbuthia received Sh 3,999,996 from Meritorious.
Their lawyers lamented the manner in which the former directors were arrested over weekend under unclear circumstances considering their progressive ages.
The court heard that the suspects are not a flight risk and should be released on bond.
While releasing the doctors, Senior Principal Magistrate Theresa Nyangena ruled that she had considered the age of the accused persons especially doctor Obwaka.
“These are people who can not be said to be at flight risk. For those reasons I have allowed a personal bond of Sh 5 million with two contact persons,” the magistrate ruled.
The accused persons were also ordered to attend court without fail when required, failure to which the bond will be cancelled and strict terms imposed.
