Five former directors of Wendano Matuu Company Limited have been charged with over 23 counts of forgery.
Stephen Ndambuki Muli, Onesmus Muisyo Kimatu, Benedict Mackenzie Mutuku, Harrison Nzioki Muya and Christopher Muindi Nziba are accused of making false minutes of special general meeting of the company held on 14th February 2020 at Wendano offices, purporting it to be genuine minutes of the special general meeting issued by Wendano Matuu Company Limited.
The businessmen are also charged with forging a CR 12 dated 25th February 2014 purporting it to be a genuine CR 12 issued by the department of the Registrar of Company Limited.
In addition, the accused persons are facing about 20 other counts of forging signatures in the minutes of special general meeting supplied and received at Kangundo Law Court on 1st July 2020 and Environmental and land court Machakos, purporting them to be genuine.
According to the charge sheet, there were other forged signatures in the Wendano Matuu Company Limited Members register.
Kimatu, Mutuku, Muya and Nziba denied the charges before Principal Magistrate Gilbert Shikwe.
The first accused person, Muli, did not appear in court to answer to the charges.
Summons were issued against him to appear on 17th December 2024 fot plea taking.
The accused persons had opposed pleading to the charges against them on grounds that the issue resulting to the charges revolves around the directorship of the company.
The court heard that there is a High Court matter that is pending judgement at the High Court in Machakos.
However, the prosecution opposed the application to defer the plea taking on grounds that there is no court order barring them taking plea.
“In the absence of such orders, the application is, therefore, not merited, we pray that the accused proceed and take plea,” the prosecution added.
The accused persons were released on a cash bail of Sh 100,000 each.
