It is a blow for former Migori County Governor Okoth Obado and his co-accused persons after the High Court ruled that they have a case to answer in the murder of Sharon Otieno.
Justice Cecilia Githua ruled that the prosecution had adduced enough evidence to put them on their defense.
The former County boss, his personal assistant Michael Juma Oyamo and Migori County Clerk Casper Obiero were charged with the death of the then Rongo University student and her unborn baby in September 2018.
However, Justice Githua acquitted them of the offense of killing her seven old month old fetus.
According to the judge, the prosecution presented a charge of murder instead of a charge of terminating the life of an unborn baby.
“I find each accused with a case to answer on count one and acquit them on count two, accordingly,” the judge ruled.
Sharon was seven months pregnant for Obado when she was found dead at a thicket in Oyugis with several stab wounds, one which pierced through her abdomen killing her baby.
It is alleged that she was killed between 3rd and 4th September 2018.
The defense hearing will commence on 25th February 2025.
