A former Permanent Secretary has been charged conspiracy to defraud Hasmita Patel T/A Holloway Properties Limited land worth Sh 350 million in Athi River.
Dave Munya Mwangi is accused of committing the offense by forging a grant LR N.O 80202 for the land measuri 1.591 hectares, dated 23rd November 2001 purporting it to be a genuine grant.
The former Internal Security PS is alleged to have committed the offense on unknown dates and place in Kenya, jointly with others not before court.
The accused is also charged with two counts of forging signatures of commissioners of land.
According to the charge sheet, Mwangi forged the signature of Sammy Silas Komen Mwaita and Jane Kanja (both commissioners) on the said grant.
In addition, the accused is charged wih uttering the forged grant to Police Constable Omar Fadhila CFE.
The court heard that he uttered the forged document on 18th December 2023 at DCI Headquarters.
Lastly, Mwangi is accused of obtaining Sh 12 million from Onda Concrete Limited by falsely pretending that he was able to lease the said land to them.
He allegedly committed this offense on or before 10th November 2023, jointly with others not before court.
Mwangi denied the charges before Senior Principal Magistrate Ben-Mark Ekhubi.
He was granted a bond of Sh 20 million with alternative cash bail of Sh 5 million.
He will also be required to provide one contact person to secure his release pending the hearing and determination of the case.
The matter will be mentioned on the 21st January for pre trial.
