Kenyan Gospel artist Alex Nyachonga Apoko alias Ringtone has been charged with Sh 50 million land fraud.
Ringtone is charged alongside Alfred Juma Ayora with conspiracy to defraud one Teresiah Adhiambo Odhiambo her land parcel number NAIROBI/BLOCK 99/142 measuring approximately 0.1908 Hectares valued Sh 50 million
The two are accused of doing so by means of claiming adverse possession claiming that they have lived therein for over two decades, a fact they knew to be false.
Ringtone and Ayora are alleged to have committed the offense on or before 28th February 2023 at unknown place in Kenya.
Ayora is also charged with False swearing and perjury after giving false information in an affidavit.
The court heard that on the 28th February 2023 in Nairobi before S.M. Katonya advocate, a person authorized to administer oath, Ayora falsely swore in an affidavit upon a matter of public concern to the effect that he had resided on the said land for two decades, a fact he knew to be false.
In addition, the accused is charged that on the same date, in a judicial proceeding in Environment and Land Court case number E012 of 2023 (OS) in which he was the petitioner while Teresiah Adhiambo Odhiambo and the Chief Land Registrar were the respondents, in an affidavit sworn before S.M. Katonya advocate and commissioner for oaths and filed in the said application, knowingly gave false testimony touching on the said application pending before the said court that he has resided on the said land for two decades, a fact he knew to be false.
The accused persons denied the charges before Senior Principal Magistrate Dolphina Alego.
Ringtone and Ayora will be remanded until Monday, 19th May when the court will rule to whether to grant them bail.
