Kenyan Ambassador to Cuba opposes closure of file in suit against KCB

The Kenyan Ambassador to Cuba Everlyne Mwenda Karisa has opposed an closure of a file in a case where she has sued the Kenya Commercial Bank over fraudulent transactions from her account.

The matter was coming up for mention to close the file after confirmation of payment.

However, Karisa’s lawyer Danstan Omari opposed closure of the file on grounds that KCB had no documentary proof of the alleged refund of Sh 779,603.

Honourable Lucy Njora directed the application to be disposed by way of written submissions within seven days thereof after which the court will deliver its ruling on 20th March 2026.

The ambassador moved to court in December 2025 seeking orders suspending any further transactions from her accounts.

She also wants the court to issue an order compelling KCB to appear before court and provide a report on how the fraudulent transactions occurred.

According to court documents, at all material times the ambassador has been operating the online banking platform from Cuba where she has been stationed since October 2024.

It is alleged that her Safaricom line was last active on 13th October 2025 at the Jomo Kenyatta International Airport as she travelled back to Cuba.

However, the ambassador had fraudulent transactions authenticated on her account on the 11th and 12th November 2025.

“Any activity purportedly authenticated through the applicant’s Kenyan lines after 13th October 2024 is inherently suspicious and invalid,” Omari said.

On 11th November 2025, a fraudulent mobile money transfer of Sh 150,000 was unlawfully effected from her bank account to her mobile number, which amount she neither received nor authorized.

Seven other fraudulent transactions were effected without her authority including a KCB salary loan advance of Sh 92,303 and another one of 33,800.

The court heard that the applicant’s dollar account with the respondent, held at Garden Plaza Branch is linked with her Kenya Shillings account and, as such, remains exposed to the risk of further unauthorized access and fraudulent transactions.
