A businessman has been charged with forging a payment plan installment agreement.
Josiah Mwale is accused of forging the said agreement consent dated 27th February 2024, purporting it to have been signed by Khatibu Mwinyi Haji Khatibu alias Babu.
Mwale is alleged to have committed the offense on unknown date and place within the Republic of Kenya, with intent to defraud and deceive.
In addition, the accused is facing two counts of uttering the forged document.
The court heard that Mwale, knowingly and fraudulently uttered the said document to Peter Ayulo on 1st March 2024 at Milimani Commercial Court in Nairobi.
The accused also uttered the forged agreement to Khatibu on 2nd March 2024.
Lastly, Mwale is facing two charges of giving false information to the police on 26th April 2024 at the Regional Criminal Investigations office in Nairobi.
The court heard the accused informed Sergeant Levi Endege that while in a company of Mbeki Auctioneers Staffs, that he was threatened by Khatibu and Shahid Muhammad Czeshan, information he knew or believed to be false, thereby causing a report to be made at the Occurrence Book under OB NO. 05/26/4/2024, which the said officer ought not to have done if the true state of facts given had been known to him.
He also lied to the said officer that he had entered into a payment consent involving Sh 15,500,000 with Khatibu and Czeshan and that the two had breached the agreement and was seeking police assistance to the matter, which information he knew to be false.
The accused denied the charges before Senior Principal Magistrate Ben-Mark Ekhubi and was released on bail.
