A man has been charged with obtaining Sh 45.5 million by false pretenses after selling land that had been auctioned by a bank.
Hussein Ibrahim Mohamed is accused of obtaining the money from Messer’s Fenoon Star Real Estate and Contracting Limited by falsely pretending that he was in a position to sell to them a property known as Land Title No. NAIROBI/ BLOCK 104/389 situated at Ushirika Estate, Eastleigh in Nairobi City County a fact you knew to be false.
According to the charge sheet, Mohamed wanted to sell the property while well aware that it had been sold out by DIB Bank Kenya Limited on public auction through Keysian Auctioneers on 24th November, 2021 upon upon him defaulting loan repayment.
It is alleged that he committed the offense on diverse dates between the 22nd April and 7th July 2022 in Nairobi, jointly with another not before court, with intent to defraud.
Mohamed is also charged with conspiring with another not before court to defraud Messer’s Fenoon Star Real Estate.
He denied the charges before Senior Principal Magistrate Dolphina Alego.
The magistrate granted him a bond of Sh 10 million with alternative cash bail of Sh 5 million.
