A man has sued the Inspector General of police for failing to arrest suspects who intermeddled with the property of his late sister, months after the Director of Public Prosecution approved charges.
Erick Matakwa Okeno who is the administrator of his late sister’s estate accuses one James Ovid Shugars Yhap of claiming to be the sister’s husband and fraudulently seeking control of her property.
These issues prompted Okeno to report the matter to the police in January 2025 and after a year of waiting, the DPP finally approved the charges in January 2026.
The petitioner accuses Yhap and his agent Farouki Omar Mzee of orchestrating a scheme to defraud them by obtaining fictitious documents indicating that the said property was jointly owned by Yhap and the deceased.
Through lawyer Danstan Omari and James Onduso, the petitioner states that since the charges were approved, the police are yet to arrest and present the suspects in court.
Upon reviewing the file, the DPP found that the property, which is situated in Kikambala, is legally owned by the deceased having legally acquired it in 2009 as indicated in the lands office hence approved charges against Mzee.
“The said decision is yet to see the light of day as the 2nd respondent (Mzee) exercising such powers under the 3rd respondent (Yhap) is still walking free and purportedly untouchable, the decision to charge notwithstanding,” the petitioner states.
