Naivasha MP Jayne Kihara fails to plead to charges, released on person bond

Naivasha Member of Parliament Jayne Njeri Kihara has failed to plead to charges of offensive conduct after being arraigned in court.

Kihara failed to plead to the charges after her defense team led by Wiper Party leader Kalonzo Musyoka and Ndegwa Njiru told the court that the charge sheet was defective.

The court heard that the plea should be deferred since the section stated on the charge sheet and particulars of the offense do not go hand in hand.

Kalonzo told Senior Principal Magistrate Ben-Mark Ekhubi that the MP was only exercising her freedom of speech and did not commit any offense.

“She was just expressing freedom of speech, no offense was committed,” he said.

It was his submission that other leaders have said worse things including hiring goons to stop the saba saba demonstrations.

Njiru also admitting the charge as it was would be limiting her rights as no offense has been disclosed.

The court heard that MP Kihara did not use any threatening, abusive or insulting words or behavior.

The prosecution opposed the deferment of plea taking on grounds that the magistrate has jurisdiction to interpret the Constitution and allow the matter to proceed.

The magistrate granted the lawmaker personal bond pending the ruling on the applicability of the charge. The ruling will be delivered on 29th July 2025.

Kihara was dramatically arrested at her home in Naivasha on 17th July 2025 over remarks she made against President William Ruto on 8th July 2025 in regards to the saba saba demonstrations.
