The police have denied holding Dela Ward Member of County Assembly Yussuf Hussein who was abducted two weeks ago.
The Inspector General of Police, through Senior Superintendent of Police Justus Imani told the court that Hussein is not in their custody nor in any police station within the country.
While opposing allegations by Hussein’s family that their kin was in their custody, Imani said that investigations into the abduction started after a report was made on 13th September 2024.
“A report was made at Industrial Area police station by the taxi diver who was carrying the victim. He also handed over the phone of the victim which had been left in his car,” Imani said.
The officer also told the court that CCTV footage obtained had been submitted for forensic analysis since it was not very clear to try and identity the two Prado vehicles that were allegedly used by the abductors.
However, when the officer was questioned on whether they had obtained other CCTV footages from the route used by the abductors, he told the court that they had requested for the same from the owners in vain.
The High Court had ordered the police to produce missing MCA in court on 27th September 2024 if he was in their custody.
Justice Alexander Muteti also ordered the police to give an explanation should they fail to produce the MCA in court.
Through lawyer Danstan Omari, Hussein’s family moved to court seeking orders to have the Inspector General of Police and the DCI produce him in court.
In the application, Hussein’s cousin, Abdikadir Adibdullahi Ahmed wanted the court to summon the IG and DCI in whose custody they believed their kin to be.
The court heard that the MCA was kidnapped from a taxi while on his was to Pangani from South C on 13th September 2024 at around 9 PM.
The taxi driver said in his affidavit that the alleged kidnappers were driving in two Land Cruiser Prados and accosted the MCA along Lusaka Road forcing him out of the taxi at gun point.
