
Three brothers have opposed the move by the Director of Public Prosecution to prefer fresh charges against them in the Sh 350 million NSSF land fraud.
Harish Ramji Manji, Ashvin Ramji Manji and Bharat Ramji Manji opposed the move by the DPP on grounds that they have already been charged with similar charges in s different court.
Through their lawyers, the brothers told Chief Magistrate Dolphina Alego that they are facing similar charges before Senior Principal Magistrate Ben-Mark Ekhubi.
The court further heard that there is a stay order from the appellate court but the DCI went ahead to arraign them in court over the same matter.
According to the charge sheet, the trio is facing charges of forgery, making false documents and obtaining registration by false pretenses.
The court heard that the three conspired to forge a transfer document dated 27th May, 2010 purporting it to be a genuine transfer document signed by Board of Trustees National Social Security Fund, a fact they knew to be false.
The offense was allegedly committed on or before the 27th May 2010 within the Republic Of Kenya, Jointly with Olothers not before court, with intent to defraud NSSF a parcel of land LR.NO.11895/50.
The said land is located within Mavoko municipality and measures approximately 3.043 Hectares and valued approximately 350 million.
In addition, the accused persons are accused of making a transfer document and a certificate of title for the said land without authority, purporting it to be a genuine transfer document signed by NSSF Board of Trustees.
The three are further charged with forging the title and certificate of transfer for the said land.
The magistrate released the three on a personal bond of Sh 200,000 and directed the matter to be mentioned on 7th December 2025 for her to compare the two files.
