Three men have been charged with conspiracy to defraud Landmark Freight Service Limited a parcel of land worth Sh 1.6 billion.
John Gitau Ngumi, Atek Otech Richard and Bernard Otieno Mallo are accused of conspiring to defraud Landmark of Land Reference Number 21068, measuring approximately 0.6724 hectare by falsely pretending that they were the genuine owners of the said land, a fact they knew to be false.
The trio is alleged to have committed the offense on unknown date and place within the Republic of Kenya, jointly with others not before court.
The accused persons are are also charged with unlawfully making a title deed I.R. No. 143069 in favour of Beba Freight Limited purporting it to be a genuine and valid document issued by the ministry of lands.
In addition, the three are accused of unlawfully making an allotment letter Ref. No. 57458/XVI dated 6th July, 1995 in favour of Beba Freight Limited purporting it to be a genuine and valid document issued by the Commissioner of lands.
Mallo is facing two charges of uttering the false documents on 2nd July 2024 to the Deputy Registrar in the Environment and Land Court purporting them to be genuine documents.
Lastly, Mallo is charged with perjury after knowingly giving false testimony touching on a matter which was material to a question then pending in that proceeding.
The accused is alleged to have committed the offense on 2nd July 2024 in a judicial proceeding in case Number E264 of 2024 – Beba Freight Company Limited Vs Bharat Ramji Manji and 3 others in a supporting affidavit dated 2nd of July, 2024 sworn before Ruth Emanikor, a Commissioner of Oaths in the Republic of Kenya filed in the said case.
Ngumi and Richard denied the charges before Principal Ben-Mark Ekhubi and were released on a cash bail of Sh 250,000.
Mallo did not appear in court to plead to the charges. His plea was deferred to a later date when he will appear in court.
