Two Progressive Credit Limited employees, spouse, sister-in-law face Sh 30M theft

Two employees of Progressive Credit Limited , a spouse and sister-in-law have been charged conspiring to steal over Sh 30.9 million from the lender

Francis Masai Musyimi, his spouse Mercy Mbinya Muthoka, his sister-in-law Charity Maua Muthoka and co-worker Nicholas Muia Kyengo are accused of jointly conspiring and committed a felony namely stealing of Sh 30,998,000, the property of Progressive Credit Limited.

The four are alleged to have committed the offense on diverse dates between 12th April 2022 and 18th July 2024 in Nairobi.

Musyimi’s spouce, Mercy Mbinya Muthoka is facing a solo charge of stealing Sh 15,499,000 from the lender between the above dates.

The couple (Musyimi and Mercy) are also charged with money laundering

It is alleged that the duo engaged in an arrangement and stole from Progressive Credit Limited, cash which they utilized towards purchase of a motor vehicle while you reasonably knowing that the property formed part of proceed of crime.

The two also have an alternative charge of acquisition of proceeds of crime.

According to the charge sheet, the couple acquired from the lender Sh 850,000 while knowing the said money formed part of proceeds of crime and utilized it to purchase the vehicle – a Toyota Caldina.

The three, with the exception of Kyengo denied the charges before Senior Principal Magistrate Ben-Mark Ekhubi.

Kyengo did not appear in court to answer to the charges. A warrant of arrest was issued against him

The trio will remain in custody until 13th December 2024 when the pre-bail report will be availed to guide the court in issuing appropriate bail and bond terms.
