Magistrate in Babu Owino’s attempted murder case recuses himself

The magistrate handling the attempted murder case against Embakasi East MP Paul Ongili alias Babu Owino has recused himself.

Chief magistrate Francis Andayi indicated that his decision was as a result of complaint by DPP Noordin Haji to the JSC on the bail terms he granted the lawmaker.

Andayi referred the matter to Principal Magistrate Bernard Ochoi who will be handling it.

The matter will be mentioned on 2nd March 2020.

Babu Owino is charged with attempted murder of DJ Felix Orinda alias DJ Evolve at B club in Nairobi and disorderly conduct.

He denied the charges and was released on a cash bail of Sh 10 million whereby he was to first par Sh 2.5 million to secure his release.

Dissatisfied with the ruling, the DPP promised to revisit it terming it a ” never heard of ruling “.

Babu was to pay the 10 million in four instalments, amounts which would be used to clear the victim’s hospital bill in the best medical facility until he fully recovers.

The court further directed that any unutilized amount would remain in court until the case is concluded.

He would further produce two sureties of equal status.

The magistrate further directed the lawmaker not to take alcohol or narcotics in public places or interfere with witnesses until the case is heard and determined.
