Court orders police to produce missing Dela Ward MCA in court

The High Court has ordered the police to produce missing Dela Ward Member of County Assembly Yussuf Hussein in court on 27th September 2024 if he is in their custody.

Justice Alexander Muteti also ordered the respondents to give an explanation should they fail to produce the MCA in court.

The court further ordered the Attorney General to be served and appear in court on 27th September. In the alternative, the directed that the AG can send a representative in the matter.

In addition, the court ordered the Director of Public Prosecution to obtain instructions from the IG and DCI and return with proper instructions to enable the court to give the proper directions regarding the disposal of the main application.

Hussein’s family moved to court seeking orders to have the Inspector General of Police and the DCI produce him in court.

In the application, Hussein’s cousin, Abdikadir Adibdullahi Ahmed was the court to summon the IG and DCI in whose custody they believe him to be.

Through lawyer Danstan Omari, the family states that the MCA was kidnapped from a taxi while on his was to Pangani from South C on 13th September 2024 at around 9 PM.

He added that the alleged kidnapers were driving in two Land cruiser Prados and accosted the MCA along Lusaka Road forcing him out of the taxi at gun point.

According to Omari and the family, Hussein’s whereabouts remain unknown and unaccounted for and there is reasonable fear that he was abducted by officers attached to the respondents (police and DCI) whom have refused to either allow his family to visit him in custody and/or refused to present him before a court of law to answer to any charge in law.
