Four charged with Sh 3.4 billion land fraud belonging to Drumvale Cooperative society

Four businessmen have been charged with Sh 3.4 billion land fraud belonging to Drumvale Cooperative Farmers Society.

Mohamed Kuroyow Mohamed, Mohamed Salat Ibrahim, Omar Khalif Adan and Adow Ahmed Mohamed are accused of conspiring with others not before court to defraud Drumvale Cooperative Farmers Society their parcel of land valued at approximately Sh 3.4 billion situated in Mavoko, Machakos County.

The suit property is IR 237120 LR 8529/10 original number 8529/11 measuring approximately 141.5 ha.

The accused persons are also charged with obtaining registration of the said land by false pretenses.

The court heard the four willfully procured for themselves a certificate of lease for the said land by falsely pretending that it was genuine.

It is alleged the accused persons committed the offense on unknown dates and place within Kenya.

In addition, the four are charged with forcible detainer of the said land.

According to the charge sheet, on diverse dates between 5th August 2018 and 23rd June 2022 at Mavoko, they were found in possession of the said parcel of land without colour of right in a manner likely to cause breach of peace to those entitled by law to be in possession of the said land.

Kuroyow, Salat and Ahmed denied the charges before Senior Principal Magistrate Robinson Ondieki.

Khalif was not present in court to plead to the charges on grounds that he was unwell.

The court heard the ownership dispute of the suit property is already before the Environment and Land court.

They were granted a bond of Sh 10 million plus one surety of a similar amount with alternative cash bail of Sh 8 million.
