Kajiado Land registrar charged with Sh 14 million land fraud

A Kajiado Land Registrar and another have been charged with Sh 14 million land fraud.

Jonathan Kimutai Koskei and Victor Baraza Odhiambo are accused of making a land sale agreement between themselves dated 1st March 2013 purporting it to be genuine and drawn by M. Korongo and Company Advocates.

The duo is alleged to have committed the offence on or before 1st March 2013, at an unknown place in Kenya with intent to defraud Hadiko Company Limited of land parcel number Kajiado/Kitengela/30828.

Odhiambo faces a solo charge of procuring registration of land title deed for the said land by false pretences.

The court heard that on an unknown date at Kajiado County land registry within Kajiado County, he willfully procured for himself registration of land title deed which measures 0.09 Hectares, valued at Sh 14 million by falsely pretending that the said property was genuinely transferred to him.

In addition, Koskei is accused that on unknown dates between September 2013 and February 2014, at Kajiado Land Registry within Kajiado county, he willfully destroyed the green card and documents contained in the parcel file including transfer forms with intent to prevent their use as evidence in a judicial proceeding.

Koskei is further charged that on diverse dates between 3rd May 2012 and 5th August 2013 at Kajiado land registry within Kajiado County, being a land registrar used his office to improperly confer a benefit by transferring the said land to his name and used the same as a collateral at I&M Bank Kenyatta Avenue branch to obtain a loan of Sh 13 million.

The duo denied the charges before Chief Magistrate Lukas Onyina and were granted a bond of Sh 1 million each.
