Property war lands daughter in court for meddling with late father’s estate

A woman has been charged with conspiracy to defraud her late father’s estate and forging a title deed for a property worth Sh 110 million located in Eastleigh, Nairobi.

Nadra Modhihiri Mohamed is accused of conspiring to defraud her late father, Modhihiri Mohamed Modhihiri of property LR No.36/VII/465 measuring approximately 0.2085.

Mohamed is alleged to have done the same by falsely drawing a forged indenture of conveyance purportedly registered pursuant to presentation number 447 of 8/12/2011 under volume N44 Folio 14/4 file 13552, a fact you knew to be false.

The accused is also charged with forging a title deed for the said parcel of land purporting it to be a genuine title deed issued by the Ministry of Land.

In addition, Mohamed is accused of obtaining registration of land by false pretenses.

Mohamed is said to have obtained registration of the said parcel of land by falsely preparing an indenture of conveyance in consideration of the sum of Sh 30 million pretending that she had bought from the late Modhihiri Mohamed Modhihiri, a fact she knew to be false.

It is alleged that she committed the above offenses on or before 5th November 2011 at an unknown place within the Republic of Kenya, with intent to defraud the estate of the late Modhihiri Mohamed Modhihiri.

Lastly, the accused is facing the charge of intermeddling with the property of a deceased person.

The court heard that on or before 14th June 2018, jointly with others not before court, Mohamed meddled with the property of her late father by fraudulently taking possession and disposing it off.

She denied the charges before Principal Magistrate Gilbert Shikwe.

The complainant’s lawyer Hassan Nandwa had asked not to grant Mohamed bail on grounds that she is likely to interfere with witnesses.

“My client, the complainant is vulnerable to her intimidation,” Nandwa told the court.

The lawyer added that should the court decide to grant her bail, stringent terms should apply.

In his ruling, the magistrate found that no affidavit had been sworn in opposition of bail and released her on a cash bail of Sh 300,000 plus two contact persons.

The case will be mentioned on 13th December 2024.
