
Two businessmen have been charged with defrauding a foreigner over Sh 164 million in a non-existent gold deal.
Emmanuel Wafula Othatcher and Willy Kiplimo Kimeto are charged alongside their companies Unaidisa Services Limited and Indipth Mining Limted.
The accused persons are accused of obtaining a sum of USD 1,271,200.74 from Tanner Caldwell Cook by falsely pretending that he was in a position to facilitate the sale of 2,820 Kgs of gold to him, a fact he knew to be false.
Othatcher and Kimeto are alleged to have committed the offense on diverse dates between 31st March and 30th May 2024 in Nairobi, jointly with others not before court and others already before court.
In another count, the accused persons are charged with conspiring with others not before court and others already before court to commit the offense of stealing.
They denied the charges before Chief Magistrate Lukas Onyina and were granted a bond of Sh 2 million with one surety of a similar amount.
The case will be mentioned on 24th January 2024.
