Lugari MP Nabii Nabwera files defamation suit against DG Savula over HIV status remarks

Lugari Member of Parliament Nabii Nabwera has files a defamation suit against Kakamega Deputy Governor Ayub Savula over remarks painting him as a HIV positive person.

The MP wants the court to compel DG Savula to tender an unequivocal public apology and retract all the injurious, defamatory and derogatory statements he made in respect of  his HIV status and performance record, to wit, “…shule zetu zinaanguka sababu ya huyu mtu amekondakonda ako na ukimwi….”

Nabwera also wants the court to bar Savula from personally, through his agents, servants, cronies, proxies and/or people working under his instructions, from making any defamatory, derogatory and maligning statement, both personal and political, aimed at tarnishing and negatively painting his name in bad light, in his capacity as the MP for Lugari Constituency.

Through his lawyers led by Danstan Omari, the MP wants the court to order Savula to pay him Sh 100,000,000 as compensation for damage caused to his otherwise stellar name and reputation, spanning both global and domestic influence.

The MP claims that as the general elections are drawing near, there has been a consistent effort by the deputy governor, his agents and proxies to, by whatever means, malign and defame him in a bid to settle political scores, aimed at tarnishing his stellar performance in his constituency.

“The defendant is hellbent on completely maligning and tarnishing my name, in a bid to politically endear himself to the people of my constituency, where he initially served as a member of parliament for a two-year term, before running for his current position as Deputy Governor of Kakamega county and losing touch with my constituents,” Nabwera said.

The said defamatory remarks by Savula were made during the burial of Munyuki Secondary school principal Simon Isiaho Shange in respect to his death.

According to a demand letter to Savula dated 14th January 2025, the said remarks are extremely vicious, inaccurate, derogatory, defamatory and geared at tarnishing and maligning the MP’s name.

Nabwera claims that on  25th November 2025, at Ludodo village in Likuyani Sub-County, within Kakamega County, Savula took to the podium during the burial of the late Principal and made the defamatory remarks against him in respect of the death, by accident, of the said principal.
