Controversial car dealer Joseph Kairo Wambui, alias Khalif Kairo has filed an application seeking recusal of the trial magistrate hearing his criminal case.
Kairo accuses Senior Principal Magistrate M. Murage of bias leading to him losing faith in the courts’ impartiality.
According to his affidavit, Kairo claims the magistrate will not dispense blind justice in his case.
He claims that there is no emergency or necessity barring the recusal of the court from the matter.
“There is no legal or procedural impediment to the court stepping aside,” the car dealer claims.
Kairo further claims that attempts to review his bond terms were frustrated by the court’s discretionary powers, which he argues are not always subject to appeal or revision.
In addition, the businessman states that the process of verifying his surety was intentionally dragged leading to his continued detention until 28th April 2025.
He accuses Kenya Revenue Authority (KRA) of intentionally delaying to verify the PIN of his surety despite the simplicity of the task.
The accused person blames his frustrations on one complainant by the name Marion Cheptoo.
He states that Cheptoo warned him at the beginning of the matter that she would “use the justice system to teach him a lesson.”
