Man charged over Sh 61M gold scam, lawyer to plead to charges

One of the suspects in Sh 61 million gold scam case has been arraigned in court.

Patroba Odhiambo Tobias alias Ishmael is charged alongside High Court advocate Alphonce Collins Odoyo Osewe who did not present himself in court to answer to the charges.

The court heard heard that Osewe is unwell and currently admitted in hospital hence his absence from court.

Tobias and the lawyer are accused of jointly obtaining USD 260,400 (Apprx. Sh 35,737,296)  from Bernard Shiaundu Aete by falsely pretending that they were in a position to sell to him 400 Kilograms of gold bars, a fact they knew to be false.

Osewe is also charged with obtaining Sh 26,100,00 from Adeyeye Enitan Ogunwusi by falsely pretending that he was in a position to sell to him 400 Kilograms of gold bars, a fact he knew to be false

The two are facing several other charges of acquisition and use of proceeds of crime.

It is alleged that they committed the offenses on diverse dates between 1st and 9th May 2023 in Nairobi.

Tobias denied the charges before Chief Magistrate Lukas Onyina.

The court allowed the prosecution’s prayer to argue the bail and bond application on 23rd September 2025.

In addition, Osewe was ordered to table medical documents in court on the same day so that the court can make a determination on his application to defer plea taking.
