Court halts prosecution of doctor, nurse accused of medical negligence

A Nairobi court has issued orders restraining the arrest and prosecution of two medical practioners accused of negligence.

Senior Principal Magistrate Theresa Nyangena issued the orders following a similar order from the High Court.

The magistrate ruled that the High Court order takes precedence and ordered suspects doctor Jane Njeru Kamau and nurse Vivian Chebet Masai, not to be arrested pending conclusion of the High Court matter.

A warrant of arrest had been issued against the suspects for failing to appear in court.

However, their lawyers led by John Khaminwa asked the court to lift the warrant as the suspects were unwell hence unable to attend court.

Kamau and Masai are accused of negligence in the treatment of a female patient by administering by an unregistered drug namely Mounjaro (TRIZEPATIDE 7.5MG) without proper diagnosis, due care, and professional diligence, thereby causing harm to the said patient.

Kamau is also charged with selling unregistered drugs by selling the said drugs (TRIZEPATIDE 7.5MG) to the patient, which drug was not registered by the Pharmacy and Poisons Board.

The court heard that the High Court matter will be mentioned on 17th March 2026 and the criminal case will await the decision of the High Court.
