Three in court for unlawfully unlocking M-kopa phones

Three men arrested in Nairobi CBD for allegedly being notorious in unlawfully unlocking M-kopa phones will remain in custody as police conclude investigations.

Jeremiah Njoroge, Marvin Wandugo and Victor Kimani were arrested after the matter was reported by one Joseph Mutiso, an employee of M-kopa Kenya Limited.

The trio was arraigned before Senior Principal Magistrate Ben-Mark Ekhubi where the police sought orders to detain them for 7 days to conclude investigations.

According to an affidavit by Inspector Beth Kariuki, Mutiso had received information from members of the public that there was a person within town who was unlawfully unlocking the M-Kopa phones.

Later the police proceeded to one shop within Tom Mboya street and found Kimani being in possession of five various types of phones

It is alleged that Kimani led the officers to another shop at Intermark Business Center along Taita Taveta road where Njoroge and Wandugo were found red-handed unlocking various types of phones.

“Upon interrogation, the respondents could not account for all the electronics which were in their room,” the Inspector added.

The court heard that the police need time to establish the owners of the recovered items, conduct forensic analysis among others.

The court further heard that the respondents are a flight risk and may abscond if released at the moment.

Their lawyer opposed the application saying the three were not a flight risk and were ready to cooperate with the police.

The magistrate ruled that the respondents be detained for four days.
