Court orders Government to produce missing lawyer Nandwa, client within 24 hrs

High Court has ordered the government to produce in court lawyer Prof Hassan Nandwa and his client Elgiva Bwire within 24hours.

Justice Anthony Mrima ordered the Attorney General and Inspector General of Police to produce the two after they went missing on Thursday last week,

The lawyers umbrella body, Law Society of Kenya (LSK) moved to court seeking orders to compel the state to produce Nandwa together with Bwire who had been released from prison the same day he was abducted, dead or alive. Bwire had just completed a 10 year sentence after being found guilty of associating with terrorists.

LSK is also seeking an order compelling Safaricom Limited to provide the lawyer’s mobile phone call records and BTS (Base Transmitting Station) records and logs of his client from 9:00 a.m. Thursday October 28, 2021 to November 2, 2021 midnight.  

The lawyer who is also an Islamic scholar disappeared while on his way from his office located within Jamia Mosque to his residence on Ngong Road in Nairobi. 

Prof Nandwa had represented Bwire, a terrorism convict, who vanished soon after release from Kamiti Maximum Prison on the October 28.

Bwire was received by his mother who had also been kidnapped but released soon after.
