Diaspora Design build limited director charged

A former director at Diaspora Designed Build Limited has been charged with obtaining goods worth over a million shilling by false pretenses.

Jonathan Kariuki Njiru is accused of obtaining from Rose Nyambura Gacheru building and construction material valued at Sh 1.2 million by falsely pretending that he would pay for the supply of the said goods supplied to Diaspora Limited.

Njiru is alleged to have committed the offence between 18th July and 22 August 2014 at Lang’ata area in Nairobi jointly with another not before court, with intent to defraud.

He denied the charges before Principal Magistrate Kenneth Cheruiyot.

His lawyer told the court that the matter relates to debts owned to Diaspora where the accused was a director.

The court heard that the co-accused in the matter who had been arrested and is the current director at the said company presented himself to the police and made arrangements on how to make the payments.

On October 1st, the lawyer said his client was called by the police and tgeyarrivec at the station, they were informed thar the said co-accused had been released on a police cash bail of 50,000.

He however did not honour the deal that led to the arrest of the accused and was informed a charge sheet had been drafted.

The court heard that at the time of the offence, Njiru had already resigned.

The magistrate enquired the whereabouts of the other accused person and was informed that he had absconded court as he had been summoned to appear.

He was released on a cash bail of Sh 50,000. The case will be mentioned on 16th October.

The magistrate noted that reconciliation is allowed if there is a chance.
