Dr Ouma Oluga may may be sued for contempt of court over mandatory vaccination

Dr Ouma Oluga, the Nairobi Metropolitan Director of Health services will be sued for contempt of court over failure to obey a court order.

Businessman Joseph Aura has sent a demand letter to Dr Oluga over a memo he issued on 5th January 2022 asking for the compliance with non-existence and unlawful “directive” of 22nd December 2021 of “Ministry of Health guidelines ” in-person services to “Unvaccinated” persons.

According to the memo……”All persons seeking in person government services in all Nairobi City County health facilities should be fully vaccinated against Covid-19 and provide proof of vaccination….”

Through lawyer Harrison Kinyanjui, Aura says the content of the said memo by Dr Oluga violated a court order that suspended the government directive requiring proof of Covid-19 vaccination before getting in-person services.

Justice Anthony Mrima suspended the said directive pending the hearing and determination of a case filed by Joseph Aura.

According to Aura, Oluga has no such mandate either in the health Act or the constitution of Kenya and the court order is binding to him and demands he complies with the court injunction immediately.

“Failure to comply with the demand letter and cease and desist imposing preconditions of” Covid-19 Vaccination” on Kenyans to access in-person governments health services and medical facilities in Nairobi as stated in the “memo” implied, he will be cited for contempt of court on Monday,” said Aura.
