A Murang’a County MCA who had been issued a warrant of arrest for disobeying court orders has been arrested and presented before Nairobi Milimani Courts.
The Kagundu-in ward MCA was arrested on May 19th at the waiting bay of Thika District hospital in Kiambu County.
Peter Mburu Muthoni alias Solomon Kamau Nyingi told the court through his lawyer that he failed to appear before court because he was unwell and had gone to the hospital for treatment.
Muthoni was required to appear before court to answer to fraud charges he had been accused of.The prosecution requested the court not to release him until the hearing and determination of his for disobeying the court.
Charges Against him
The Jubilee Party MCA is accused of obtaining Sh 2,295,000 from Alice Peninah Wanjiku Guchu on 18th and 29th June 2016 at Pioneer house in Nairobi jointly with others not before, pretending he was in position to sell her a motor vehicle registration number KCC 630D Isuzu track.
The MCA is also accused of forging a court order for civil suit Number 1875 of 2016 for warrant to sell property from Nairobi Milimani Commercial Court dated 4 June 2016 to Alice Peninah Wanjiku Guchu purporting to be genuine court order issued by the Chief Magistrate, Milimani Commercial Court.
He is also facing a charge of personation and is accused that on 13th day of June 2016 at Leakey’s storage yard in Nairobi, with intent to defraud, he presented himself as Solomon Kamau Nyingi of identification card number 92369224 to Alice Wanjiku.
He is facing other 3 charges of making documents without authority, forgery of another court order and uttering false documents.
