Suspected Nyari land fraudsters to be charged afresh

Two people suspected to have attempted to defraud Sh 80 million land in Nyari, Nairobi will soon be charged afresh after additional charges were preferred against them.

Emanuel Okello and Elizabeth Waiyego Njangiru are accused of intending to defraund one Isaack Kamau Ndirangu of his parcel of land by forging an instrument of transfer for the said land purpoting it to be genuine drawn and filed by M/S Yunis Mohamed and Associates Advocates

The two are alleged to have committed the offence on or about 20th July 2014 at an unknown place within the republic of Kenya jointly with others not before court.

Obtaining money

Additionally Okello, Njangiru and Joem Consultants Limited are also accused of obtaining Sh 35,000,000 from Arshad Shamsudin Alibhai and Nafisa Arshad Alibhai by falsely pretending that the land was valid and genuinely registered.

It is alleged the offence was committed between 3rdNovember and 29th December 2016 in Nairobi jointly with others not before court.

Further the suspects are accused of obtaining another Sh 37,000,000 from Karim Hassanali Shariff by pretending that the land was valid and genuinely registered.

They are alleged to have committed this offence between 24th November 2016 and 28th January 2017 in Nairobi.

They are also accused of forging the signature of Advocate Mutiso Mutinda on the instrument of transfer of the said parcel of land.

In another count the suspects are charged with knowingly and fraudulently uttering a forged instrument of transfer for Ndirangu’s Land to Wanderi Mark Muigai, a senior Land Registrar purporting it to be genuine.

The accused persons together with the firm are also alleged to have obtained registration of the land by false pretenses.

False allotment letter

In another count Okello and Njangiru are accused of making a false letter of allotment for the said land purporting it to be genuine and signed by City council of Nairobi town clerk Nelson Waswa Otindo

In addition, they are accused of knowingly and fraudulently uttering a forged letter of allotment dated 28th November 2009 for the Nyari land to Advocate Norman Khangai Asega purporting it to be genuine issued by the town clerk.

The suspects are also accused of forging a letter Dated 22nd March 2016 on proposed sub division of the said land purpoting it to be genuine and signed by Dr. Robert K Ayisi, Acting county secretary, Nairobi City County.

Lastly, the duo is alleged to have uttered the forged letter to Mary Njeri Kamunyu an officer at survey department purporting it to be genuine.
