Two charged with defrauding advocate Ahmednasir Abdullahi Sh 11 million in Eastleigh land sale

Two men have been charged with obtaining Sh 11 million from Ahmednasir Abdullahi Advocates LLP by pretending they could sell to him a piece of Land in Eastleigh.

Guyo Guchana Halake and Samsom Kimani Kamau are accused of obtaining the money from Ahmednasir who was acting on behalf of his client, Mohamud Heshi Abdi by falsely pretending that they were a position to sell to him land LR 36/VII/250 (Original No. 21/5) located in Eastleigh at a cost of Sh 120 million.

The 11 million was meant to be the advance deposit for the property.

The duo is alleged to have committed the offence between 17th January and 29th March 2022 in Nairobi, jointly with others not before court, with intent to defraud.

Halake and Kamau are also charged with conspiracy to defraud. The court heard that they conspired with others not before court to defraud the advocate by pretending they were in a position to sell the said piece of land, a fact they knew to be false.

They two denied the charges before Senior Principal Magistrate Bernard Ochoi.

Kimani was granted a bond of Sh 5 million with alternative cash bail of Sh 3 million.

However, the prosecution opposed the release of Halake on bail on grounds that he a flight risk.

The court heard that he was produced in court under warrant of arrest which was issued against him by Milimani Chief Magistrate’s Court.

According to the prosecution, Halake has another a pending matter before Taita Taveta Law Courts .

The case will be mentioned on 29th September 2022 for pre-trial.
