3 Nairobi businessmen to be charged with conspiracy to defraud County land

Three Nairobi city businessmen are to be charged with conspiracy to defraud Nairobi city county a parcel of land.

Mohamed Issack Ali, Mohamed Rage Mohamed and Abdikadir Sheikh Mimin are charged with conspiracy to defraud County parcel of land No. 209/20170 IR No. 156548 purporting that the certificate of lease for the land, IR 172399 was a genuine document legally authorized by Nairobi County, a fact they knew to be false.
The accused persons are allegedĀ  to have committed the offense on or about 17th August 2011 at an unknown place within Nairobi, jointly with others not before court by deceit.
The three further face a charged of forgery. The court heard that the accused persons, with intent to deceive or defraud and without lawfully authority or excuse forged the certificate of lease BG falsely pretending that the land was leased to Wema Foundation Trust, Company limited by Nairobi City council.
Thirdly the accused persons are charged with obtaining land registration by false pretenses. The court heard that on 17th August 2017 at Ardhi House in Nairobi, willfully obtained registration of the land from the absolute registered ownership of the county go that of Wema by falsely pretending that the company was the rightful owner.
Lastly, they are to be charged with forging a public private partnership lease agreement dated 17th August 2011 pretending it was genuine and signed by County officials and the above company.
However, the accused persons did not plead to the charges as they failed to appear in court for plea taking. Chief Magistrate Francis Andayi issued warrants of arrest against the them. The case will be mentioned on 31st July.
