Court to rule whether to enjoin Governor Korane’s deputy in petition challenging his academic qualifications

High Court will make a ruling on whether to enjoin Garissa County Deputy Governor Abdi Dagane Muhumed in a petition challenging the academic papers of Governor Ali Korane on 19th September.

In a certificate of urgency, Dagane claims that being the DG, he will be affected by the outcome of the petition.

In his affidavit, Dagane claims that he has a legal interest in the suit due to the nature of his appointment and his position as the Deputy Governor and will be affected by any negative outcome of the suit.

The Independent Electoral and Boundaries Commission (IEBC), thought lawyer Paul Nyamodi opposed his application saying that only Governor Korane’s academic documents are being challenged in court.

The Ethics and Anti- Corruption Commission says it has commenced investigations into Korane’s academic qualifications.

This follows a petition filed by Aden Mukhtar Bare seeking to declare the Garissa Governor seat vacant arguing that Korane presented fake academic papers to be cleared for the gubernatorial race, thereby breaching the Constitution.

Bare, whose son Idriss Mukhtar was shot and severely injured while pursuing the matter is carrying on what his son started. The case against the suspects of the said shooting is still ongoing.

Through lawyer Charles Kanjama, Bare says that Korane breached the violated the Leadership and Integrity Act by filing and presenting certificates at IEBC during last year’s general election yet he does not possess the same qualifications.

EACC investigator Kevin Langat says that preliminary investigations shows that Korane, while seeking clearance from the commission to vie for the position of governor in 2012 and 2017 filed a self- declaration form indicating that he possesses a master’s degree from University of Nairobi.

According to the documents, in a letter dated 20th August 2018, University of Nairobi denies issuing the MBA degree certificate to Governor Korane, confirmed that the same was a forgery and that his name does not appear in any other the graduation booklet.

In addition, Langat says that preliminary investigations reveals that the said self- declaration form presented to IEBC also shows that he holds is a Bachelor of Arts in International Studies and Diplomacy from Washington International University.

However, it is alleged that a close analysis of some pages in the self-declaration from presented to IEBC reveals that information was altered to remove “MBA degree” and replace it with Bachelor of Arts in International Studies and Diplomacy from Washington International University.
