DPP Haji accused of contempt of court over charge sheet drafting

Lawyer Danstan Omari has said he intends to file contempt of court proceedings against the DPP Noordin Haji over drafting and signing of charge sheets.

Omari said that the DPP continues to draft and sign charge sheets even after the court of appeal stayed the same.

This has caused confusion in the criminal justice system as the police do not want to use the DPP charge sheet and the police do not want to use the police charge sheets.

Suspects and victims are also not left out since suspects are not charges meaning there is no justice for the victims.

According to the police, they have been frustrated by the office of the DPP since they draft charge sheets and the DPP drafts his too.

Once the police present their charge sheet to the ODPP, they are altered and put in the DPP layout; the Investigating officer is thereafter forced to sign it.

However, some of the investigators have refused to sign the DPP charge sheets.

Lawyer Danstan Omari said that they intend to sue the DPP over contempt of court for disobeying the said orders. They court of appeal has stayed the orders of Judge Mrima giving DPP powers to draft and sign charge sheets pending the hearing and determination of the appeal.

DPP Haji is accused of disobeying court orders and nepotism.

It is alleged that a fraud suspect who was arrested on 30th June 2022 for obtaining Sh 30 million by false pretenses has not been charged since the DPP has refused to register the charge sheet drafted by police.

This is allegedly because the suspect, Issadin Gabane Mohammed is related to DPP Haji.

Gabane was arrested along university way and booked at Muthaiga police station.

When produced at Milimani Law Courts on 1st July, officers from ODPP refused to have the charge sheet registered until they produce him with the ODPP charge sheet.

The suspect allegedly obtained the Sh 30 million for supply of sugar.
