DR Tanui to rule on complaints against her by Brian Yongo in Jirongo suit

High Court Deputy Registrar Elizabeth Tanui will on Monday 19th deliver her ruling on complaints made against her to the Chief Justice by businessman Brian Yongo.

In the letter dated 9th September 2018, Yongo accuses Jirongo’s wife who is a state prosecutor of pressurising Tanui to help her husband on the matter.

The businessman sued the former Lugari MP over a Sh 20 million debt he failed to pay.

In the letter, Yongo says he has received death threats because of the matter adding that senior politician from Western Kenya told him that the matter has already been compromised.

Jirongo’s lawyer said the court needed to address on the serious allegations made by the businessman against the Deputy Registrar Jirongo’s wife.

“The allegations of interference are serious and not allegations to be taken lightly” said the lawyer.

The lawyer further said the conditions imposed on his client were heavy adding that the allegations made are out to intimidate the court.

According to Yongo, it can not be a coincidence that Tanui, on four occasions when the matter is listed always has an emergency or out for a meeting.

“I seek your intervention in this matter and urge you to investigate the matters raised herein as they are grave and if the said DR is pressurized over this she should simply recuse herself…..” wrote Yongo.

Jirongo spent two nights in police custody after he was arrested over the debt and upon being presented in court, he was released on a cash bail of Sh 5 million.

It is alleged that the two had agreed that the amount will be settled in three installments; Sh 5 million in October 2015, followed by another 5 million and the final installment within 60 days.

Others alleged to have sued the politician for failing to pay their debts amounting to millions of shillings are COTU Secretary General Francis Atwoli and Businessman Sammy Kogo.

Jirongo, once upon a time a billionaire, was declared bankrupt last year by a Nairobi court.
