Ndolo is accused of creating disturbance in a manner likely to cause breach of peace by forcefully breaking into the gates of an estate where he allegedly  intimidated and commanded the security guards to walk out of their working premises.
He is alleged to have committed the offence on 17th August 2019 at Bustani gardens along Oledume road in Nairobi.
Ndolo  is charged alongside Daniel Otieno Juma, George Otieno, Cyrus Nyamboga Gichana, Bernard Ochieng Andai, Dick Otieno Ombaka and Hassan Dima Wario.

Ndolo is quoted to have uttered to Hamid…..”Wewe mjinga wa Lamu, ukileta mchezo Nairobi tutaakuua kwa kukudunga dunga na visu, usilete ushoga hapa Nairobi si kwenu, rudi Lamu na tutahakikisha tumekuuwa.”
Transalated to English the words mean……”You fool from Lamu, if you joke around Nairobi we will kill you by stabbing you with knives, You should not bring your gaysm here, Nairobi is not your place, we will make sure we have killed you.”

The six denied the charges before Chief Magistrate Martha Mutuku and were released on a cash bail of Sh 200,000.
