Intersparex Director charged with defaulting millions of tax

A businessman has been charged with claiming Value Added Tax relief not entitled and defaulting payment contrary to the tax procedure Act.

Sunil Patel alias Patel Sunil Mafatlal Marghabai who is charged Intersparex Limited was charged that between 20th January and 20th December 2017 in Nairobi, being the Director of the said registered Limited liability company, unlawfully claimed VAT relief amounting Sh 7,948,359 which he was not entitled to.

He was further charged with defaulting on an obligation imposed under a tax law. The court heard that on diverse dates between 31st January and 31st December 2016 in Nairobi, jointly with another not before court, Sunil unlawfully defaulted on paying Sh 27, 855,688, being a corporation tax due to the commissioner, as imposed by the income Tax Act Cap 470 laws of Kenya.

On 31st January and 31st December 2015 he accused of defaulting on paying Sh 22,072, 166.

He is charged with claiming Sh 3,744,652 between 20th January and 20th December, Sh 14,275,240 between 20th January and 20th December 2016 and another Sh 78,000.

He denied the charges before Chief Magistrate Francis Andayi and was granted a bond of Sh 2 million or a cash bail of Sh 1 million.

The case will be mentioned on 17th September and will be heard on 2nd October 2018.
